Terms and conditions of use

1. APPLICATION OF THE GENERAL TERMS AND CONDITIONS

These terms and conditions apply automatically to anyone entering the Leisure Park. The sale is deemed concluded on the date of acceptance of the service by the Park Management. Prior to this date, the present terms and conditions are made available to customers in accordance with article L113-3 of the French Consumer Code. All sales imply unreserved acceptance of :

  • to the present general terms and conditions, which prevail over all other conditions except those expressly accepted by the Management.
  • to the privacy policy of La Vallée des Korrigans, which can be consulted on the www.lavalleedeskorrigans.fr website.

2. SERVICES

The park’s management offers customers a leisure park set in 40,000 m² of plain and woodland, open to all, with a wide range of activities at heights or close to the ground, with or without Personal Protective Equipment (PPE). The games and activities on offer, as well as their access conditions, are listed on request at reception, with management reserving the right to modify them.

3. PARK ACCESS / SALES / RESERVATIONS

  • Access to the Park is available during the periods, days and times set out in the calendar available on the website.
  1. Tickets for admission to the Park are sold :
  • Either directly at the ticket office on the day of entry to the Park; the sale is then deemed firm and definitive,
  • Or by reservation, accompanied by a deposit, which must be made on the basis of a quotation issued by the Management and also available to customers at the Park reception desk, and returned 15 days before the planned date.
  • After this deadline, the Management may not accept the reservation, subject to availability.

Reservations are accepted, subject to availability, upon return of the order form bearing the Park’s stamp, the date of access and the deposit paid. All reservations received and accepted by the Management are deemed firm and definitive.

4. PRICES

1. Except in the case of special conditions specific to the sale, prices are those quoted on the day of booking. Rates are firm and definitive on this date. They are expressed in legal currency and include all taxes.
The prices shown in the catalog are inclusive of VAT in euros, applicable on the day of the order; any change in the rate may be passed on to the price of the products or services.

 

2. Method of payment: unless otherwise expressly stipulated in the special terms and conditions, payment for tickets to La Vallée des Korrigans may be made by cash, credit card, vacation vouchers, bank transfer or money order as follows:

Cash on the day of entry to the Park.
On quotation accompanied by a deposit of 40% and payment of the balance on the day of entry.
On presentation of an order form for public authorities and similar bodies.
Ticketing on our website: by credit card only.

Any reservation* confirmed and not cancelled 8 days prior to the date of the outing will result in the deposit being retained or the invoicing of 30% of the total amount of the quote (in the case of payment by administrative voucher).
Any confirmed reservation* not cancelled within 72 hours of the date of the outing will be invoiced at 50% of the total amount of the initial quote.
Cancellations* on the day of the outing or no-shows will be invoiced in full.

* unless we decide to close the site (e.g.: weather risks likely to disrupt the safety of participants).
No entry will be authorized without full payment on the day of entry.
Invoices will be printed on request.
In the event of cancellation of the reservation by the customer, any deposits paid will not be refunded. They will be acquired as damages.

 

3. Online ticketing: e-Ticket

GTC specific to the remote booking of services offered by La Vallée des Korrigans, whose contact details are specified in this booking confirmation document. They govern all stages necessary for the reservation and follow-up of the reservation between the contracting parties. The customer acknowledges having read and accepted the present general terms and conditions of sale and the terms and conditions of sale of the reserved rate accessible on our reservation platform. These general terms and conditions of sale apply to all bookings made over the Internet, via our booking platform.
Booking: The customer chooses the services presented on our booking platform. He acknowledges that he has taken cognizance of the nature, destination and booking terms of the services available on our booking platform and that he has requested and obtained the necessary and/or additional information to make his booking with full knowledge of the facts. The customer is solely responsible for his or her choice of services and their suitability for his or her needs, and we cannot be held liable in this respect. The reservation is deemed accepted by the customer at the end of the reservation process.

 

4. Reservation process: Reservations made by the customer are made using the online reservation form available on our reservation platform. The reservation is deemed to have been made on receipt of the reservation form. Prior to any reservation, the customer undertakes to complete the information requested on the reservation form. The customer attests to the truthfulness and accuracy of the information provided. After the final choice of services to be booked, the booking procedure includes the entry of the credit card in the case of a guarantee or prepayment request, the consultation and acceptance of the general terms and conditions of sale and the terms and conditions of sale of the rate booked before the booking is validated and, finally, the validation of the booking by the customer.

 

5. Acknowledgement of reservation: Our reservation platform acknowledges receipt of the customer’s reservation by sending an e-mail without delay. In the case of online bookings, the acknowledgement of receipt of the booking by e-mail summarizes the contract offer, the services booked, the prices, the conditions of sale relating to the tariff selected and accepted by the customer, the date the booking was made and the address of La Vallée des Korrigans to which the customer may submit any complaints.
Cancellation or modification by the customer: In accordance with article L. 121-21-8 12° of the French Consumer Code, customers are reminded that they do not have the right of withdrawal provided for in article L. 121-21 of the French Consumer Code. The conditions of sale of the rate booked specify the terms of cancellation and/or modification of the reservation: – 3 days before arrival: 100% of the total amount of the reservation collected / 4 to 15 days before arrival: 75% of the total amount of the reservation collected / 16 to 90 days before arrival: 50% of the total amount of the reservation collected / beyond 91 days before arrival, 5% corresponding to bank and administrative charges collected / no-show on the day of the service: 100% of the total amount of the reservation collected. Reservations may be cancelled directly with La Vallée des Korrigans, whose telephone number is specified on the reservation confirmation sent by e-mail. All reservations are nominative and may not be transferred to a third party, whether free of charge or in return for payment. Expiring gift cards can be renewed for a further year for a €30 fee. Please note that legislation excludes leisure ticket purchases from the withdrawal period.

 

6. Liability: The photographs presented on our booking platform are contractual. Every effort is made to ensure that the photographs, graphic representations and texts reproduced give as accurate an idea as possible of the services offered. Variations may occur between the time of booking and the day of the service. SARL BRUNO B – LOISIRS cannot be held responsible for the non-execution or poor execution of the reservation in the event of force majeure, the fault of a third party, the fault of the customer, or in the event of unauthorized prepayment by the bearer’s bank. Any reservation or payment that is irregular, inoperative, incomplete or fraudulent for a reason attributable to the customer will result in the cancellation of the order at the customer’s expense, without prejudice to any civil or criminal action against the latter.

 

7. Complaints: Any incident or dispute may, at the request of the parties, give rise to a contradictory expert appraisal within 8 days, at the expense of the claimant. Any claim relating to the present contract or to invoicing must be made within one month of the date of issue of the invoice.

 

8. Prices: Prices for booking services are indicated before and at the time of booking. Prices are confirmed to the customer in euros, inclusive of VAT, and are valid only for the period indicated on the booking platform. If the debit to SARL BRUNO B – LOISIRS is made in a currency other than that confirmed on the booking, the customer is responsible for any exchange charges. All bookings, whatever their origin, are payable in euros, unless otherwise specified on site. Unless otherwise specified on the booking platform, additional services are not included in the price. Prices include VAT applicable on the date of the order, and any change in the VAT rate will be automatically reflected in the prices indicated on the invoice date. Any modification or introduction of new legal or regulatory taxes imposed by the competent authorities will automatically be reflected in the prices indicated on the date of invoicing.

 

9. Payment : The customer communicates his bank details as a guarantee of the reservation except under special conditions or rates, by credit or private bank card (Visa, Mastercard, American Express… according to the possibilities offered by the La Vallée des Korrigans reservation platform) by indicating directly, in the area provided for this purpose (secure entry by SSL encryption), the card number, without spaces between the digits, as well as its date of validity (it is specified that the bank card used must be valid at the time of consumption of the service) and the visual cryptogram. The customer must present the credit card used to guarantee the reservation to La Vallée des Korrigans. The total amount or a deposit must be paid to validate the reservation of an activity. In the event of non-appearance on the day of the activity, La Vallée des Korrigans will charge the customer 100% of the total amount of the reservation. La Vallée des Korrigans has chosen a secure booking system for online credit card payments. The validity of the customer’s credit card is verified. A payment card may be refused for a number of reasons: stolen card, blocked card, credit limit reached, input error, etc. In the event of a problem, the customer must contact their bank and La Vallée des Korrigans to confirm their reservation and method of payment.

 

10 : Respect of privacy: The customer is informed, on each of the personal data collection forms, of the compulsory or optional nature of the answers by the presence of an asterisk. The information processed is intended for La Vallée des Korrigans, its entities, its partners and its service providers (in particular online payment service providers). The customer authorizes La Vallée des Korrigans to communicate his personal data to third parties on condition that such communication is compatible with the performance of the operations incumbent on the reservation system under these general conditions and in connection with the Customer Charter for the protection of personal data. In particular, when paying online, the customer’s bank details must be transmitted by the payment service provider to the establishment’s bank, in order to execute the reservation contract. The customer is informed that this transfer of data may take place in foreign countries which do not provide adequate protection of personal data within the meaning of the French Data Protection Act. However, the customer consents to this transfer, which is necessary for the execution of the reservation. SHHAKER SAS / lyra.com, in their capacity as professionals, have undertaken to the establishment to take all measures to ensure the security and confidentiality of the data transferred.

 

11 : Agreement of proof: The entry of the required banking information, as well as the acceptance of the present general terms and conditions and of the booking voucher or request, constitutes an electronic signature which has, between the parties, the same value as a handwritten signature. The computerized registers kept in the computer systems will be preserved in reasonable conditions of security and considered as proof of communications, orders and payments between the parties. The customer is informed that his IP address is recorded at the time of booking.

Force majeure: Force majeure refers to any event external to the parties that is both unforeseeable and insurmountable, preventing either the customer or La Vallée des Korrigans from fulfilling all or part of its obligations under the contract. Cases of force majeure or fortuitous events are those usually recognized by the jurisprudence of French courts. Each party may not be held liable to the other party in the event of non-performance of its obligations resulting from an event of force majeure. It is expressly agreed that force majeure suspends the parties’ performance of their mutual obligations, and that each party shall bear the costs arising therefrom.

Entire

The present general terms and conditions of sale, the terms and conditions of sale of the fare booked by the customer, and the reservation request express the entirety of the obligations of the parties. No general or specific conditions communicated by the customer may be incorporated into these general conditions.

 

The documents forming the contractual commitments between the parties are, in decreasing order of priority, the reservation request (including the specific conditions of the fare booked) and these general conditions. In the event of any contradiction between the booking form and the general terms and conditions, the provisions of the booking form shall be the only ones applicable to the obligation in question. The present general terms and conditions of internet sale may be modified and/or supplemented by the establishment at any time. In this case, the new version of the general terms and conditions will be posted online by the establishment. As soon as the new version of the general terms and conditions is posted on the Internet, it will automatically apply to all customers.

5. PARK CLOSURE / CLOSURE OF ACTIVITIES / CARRYING CAPACITY

  1. The Management reserves the right to close the Park or certain activities for reasons of safety, force majeure or unforeseen circumstances, for which it cannot be held responsible. In the event of closure of the Park and in the case of reservations, deposits paid will be refunded.
  2. For safety reasons, the capacity of the accrobranche is limited to 200 people using the compulsory equipment provided, with priority access to the games given to people who have made a reservation. Once this limit has been reached, all new entries will be made as soon as the equipment has been returned by those leaving.

6. RESPONSABILITY

  • Safety instructions and instructions for the use of equipment are posted at the entrance to the Park, and on specific signs at the start of each game, course or activity.
  • Management reserves the right to exclude from the Park any person who fails to comply with safety instructions.
  • Management declines all responsibility for any failure to comply with safety instructions, or for any misuse of equipment, or for any use not in accordance with its intended purpose, as stipulated in the safety instructions. Children (under 14) are under the responsibility of the adults accompanying them. Children and adults from schools, leisure centers and other organizations are under the responsibility of their supervisors. Adults and supervisory staff must ensure that safety instructions are followed and that equipment is used correctly by those under their responsibility.
  • Management declines all responsibility for loss, damage or theft of personal belongings such as clothing, cameras, glasses, keys, etc. (non-exhaustive list), which are the personal responsibility of each customer.
  • All persons using the park must have personal liability insurance.
  • Anyone using the park must read and understand the park rules and regulations, which are posted at the park entrance, in the park enclosure and on the invoice given to the customer.

7. COMPETENT JURISDICTION

For the definition of the competent Jurisdiction, the Management of La Vallée des Korrigans elects domicile in its head office.

 

All complaints must be addressed to the customer service department of the “La Vallée des Korrigans” park, in accordance with the terms and conditions of sale. In the absence of a satisfactory response from the customer relations department within 60 days, the customer may refer the matter to the Tourism and Travel Ombudsman, whose contact details and procedures are available on his website: www.mtv.travel_
